These Terms of Use ("Terms") govern your use of plumberonduty.co.za (the "Site"). By using the Site you agree to these Terms. If you do not agree, please do not use the Site.

1. Operator information (section 43, ECT Act)

In accordance with section 43 of the Electronic Communications and Transactions Act 25 of 2002, the following information is provided about the operator of this Site:

  • Operator: Plumbers On Duty (operated by a sole proprietor trading as "Plumbers On Duty")
  • Place of business: South Africa

  • Description of service: a free online directory that lists independent plumbing businesses operating in South Africa and helps consumers find and contact them.
  • Legal form: Sole proprietorship. The Site is not operated by a registered company or close corporation.

2. Nature of the directory

Plumbers On Duty is a directory and information service. We are not a party to any agreement between you and a plumber, and we do not provide plumbing services ourselves. We are not an agent or employer of any listed plumber. Any quote, contract, payment or workmanship is solely between you and the plumber you engage.

3. Listings and content

We compile listings from public sources and from plumbers who register or claim their profile. While we take reasonable steps to keep information accurate, we do not warrant the qualifications, licensing, insurance, availability, pricing or workmanship of any listed plumber. You should always verify credentials (e.g. PIRB registration) directly with the plumber and the relevant authority before engaging their services.

Reviews are submitted by users and reflect their personal experiences. We moderate reviews but cannot guarantee that every review is accurate.

4. Acceptable use

You agree not to:

  • submit false, misleading, defamatory or infringing content;
  • post a review for a business you have not actually used;
  • impersonate any person or business;
  • scrape, copy or republish substantial portions of the Site without our written permission;
  • interfere with, attack or attempt to gain unauthorised access to the Site;
  • use the Site in breach of any applicable law.

5. Plumber accounts

If you register or claim a listing as a plumber, you warrant that you are authorised to represent that business, that the information you submit is true, and that you hold any registrations or licences required to perform plumbing work in South Africa (including PIRB registration where applicable). You are responsible for keeping your account credentials secure.

6. Consumer protection

Nothing in these Terms is intended to exclude any right you have under the Consumer Protection Act 68 of 2008 or any other law that may not lawfully be excluded. Where any provision of these Terms is inconsistent with such a law, that provision will be read down to the extent of the inconsistency.

7. Intellectual property

All content on the Site (other than user-submitted content) is owned by or licensed to Plumbers On Duty. You may view and share links to the Site, but you may not copy, modify or distribute Site content without our prior written consent.

8. Disclaimer and limitation of liability

The Site is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, Plumbers On Duty disclaims all warranties, express or implied. We are not liable for any loss or damage arising from your use of the Site or your engagement of any listed plumber, except to the extent such liability cannot lawfully be excluded.

9. Indemnity

You indemnify Plumbers On Duty against any claim, loss or expense arising from content you submit, your breach of these Terms, or your unlawful use of the Site.

10. Changes

We may update these Terms from time to time. The "Last updated" date at the top reflects the latest revision. Continued use of the Site after a change constitutes acceptance of the updated Terms.

11. Governing law and disputes

These Terms are governed by the laws of the Republic of South Africa. Disputes must be referred first to good-faith negotiation by email, and failing resolution, to the South African courts of competent jurisdiction. Consumers may also approach the Consumer Goods and Services Ombud or the National Consumer Commission where applicable.
